General Terms and Conditions of Axamer Lizum (09/2022)

Contractual partner
These General Terms and Conditions govern the contractual relationship between Axamer Lizum GmbH & Co KG, FN 561403 v, Lizum 6, 6094 Axams (hereinafter referred to as Axamer Lizum) and the natural persons (hereinafter referred to as users) who use the services of Axamer Lizum.

Legal relationship to Freizeitticket Tirol and other card associations
The Freizeitticket Tirol (FFT for short) is a ticket association in the form of a partnership under civil law, consisting of the following 18 mountain railways (FFT partners for short):
Axamer Lizum GmbH & Co KG, Bergbahnen Kappl, Bergbahnen Kühtai, Bergbahnen Rosshütte, Bergbahn Silvretta Galtür, 11er Bahnen Stubai, Glungezer, Hochkössen, Innsbruck Nordkettenbahnen and Hungerburgbahn, Kellerjoch, Mutteralm Innsbruck, Patscherkofelbahn Igls, Rangger Köpfl, Schlick2000-Skizentrum/Wanderzentrum Stubai, Serlesbahn Mieders, Silvretta Seilbahn AG-Ischgl, Ski Arlberg, Bergeralm Ski and Leisure Arena, Obergurgl-Hochgurgl Ski Area, Stubai Glacier, Birkenklift Seefeld, Burglift Stans, Hüttegglift Weerberg, Katzenkopf Leutasch, Schwannerlift Weerberg, Kinderland Rinn Ski Lift, Kolsassberg Ski Area, Trins Ski Lift, Geignbühel Ski Lift, Sonnerglift Gries im Sellrai, Sonnenbergbahn Milders, Vögelsberg Wattens, Willdstättlift Wattenberg.

Contractual relationships involving the FFT are entered into directly between the user and the FFT. Axamer Lizum acts only as an intermediary in this business relationship.
The user's contractual partners are exclusively the FFT partners. The FFT partners are legally independent legal entities, which means that any liability or guarantee for incidents arising from or in connection with the operation and use of the cable cars and lifts as well as the pistes and recreational facilities shall be borne exclusively by the FFT partner in whose territory the incident occurs.
The contractual relationship with the FFT is governed by the General Terms and Conditions of the FFT (link to the General Terms and Conditions of the FFT: https://www.freizeitticket.at/agbs/) and, in the case of access to a ski area of an FFT partner, by the respective General Terms and Conditions of the FFT partner.

General conditions:
- Children born in 2018 or later do not need a lift pass / Bambini accompanied by an adult are free of charge, except for ski instruction.
- Persons born between 2017 and 2008 are considered as children.
- Persons born between 2007 and 2005 are considered as teenagers.
- Persons born between 2004 and 1959 are considered adults
- People born in 1958 and older are considered seniors.
- Persons with a disability of 60% or more are considered disabled (proof is provided by presentation of a social security certificate).

The lift pass is not transferable, not even within the family.
The Axamer Lizum lift pass is only issued on a contactless data carrier (disposable keycard). If you already have a keycard that is still working, you can use it again. If a keycard does not work, the data can be transferred to a new lift pass. The deposit for the keycard is €4. If the keycard is returned mechanically and electronically undamaged, the € 4 deposit will be refunded.
For the purchase of lift passes for the Axamer Lizum, the tariffs fixed for the respective season apply.
It is not possible to exchange the ski pass for another one, to transfer it to another person or to extend its validity.
There is no right to a refund, not even pro rata, in the event of the closure of the lift, for whatever reason, in particular in the event of natural disasters, weather conditions (e.g. storms, thunderstorms, heavy rain), lack of snow, snow chaos, due to official orders (e.g. danger of epidemics, pandemics), technical defects, maintenance work or force majeure, as well as in the event of departure.
The period of validity of the lift passes shall not be extended by any hindrance, whether on the part of Axamer Lizum or on the part of the user, or by force majeure.
In the event of impossibility, Axamer Lizum is released from any contractual obligation. In this case, the user will not have any claims against Axamer Lizum.

Conditions of use:
The Axamer Lizum lift passes or combined tickets (FTT, TSC, AGM, Ski+City Card) entitle the user to use the facilities of the Axamer Lizum during the operating and opening hours (this does not include special runs outside the normal operating hours). The operating and opening hours are also determined independently by the respective business. In the event of (partial or total) closure, for whatever reason, there is no right to a refund, not even in the form of an aliquot.
The user undertakes to respect the FIS rules when using the slopes. The FIS rules can be found on the notice board.
The instructions of the Axamer Lizum staff and the piste rescue service must be followed at all times.

Restriction on the issue of lift passes:
Axamer Lizum reserves the right to limit the issue of lift passes or individual lift passes in the event of poor snow conditions or imminent overcrowding on the slopes. Furthermore, Axamer Lizum reserves the right to change prices, even on a daily basis, e.g. for events.

Loss / Theft
In case of loss or theft of the lift tickets of the Axamer Lizum Annual Pass, the user is obliged to report this immediately to the point of sale where the Axamer Lizum Annual Pass was purchased. A replacement card will only be issued on presentation of an official report of loss and/or theft. In order to obtain a replacement card, the user must pay the following processing fees. The issue of a replacement card must be requested at the point of sale where the annual pass was purchased.

Forgotten Axamer Lizum ski pass or combined card (FTT, TSC, AGM, Ski+City Card)
If a user forgets the Axamer Lizum lift pass or the above-mentioned combined ticket, he/she must pay the normal tariff (taking into account the time of day) of the ski area.

Refund
In the following cases, the user can request a - partial - refund of the purchase price of the Axamer Lizum annual ski pass:
- Subsequent exchange for another ski pass and transfer to other persons as well as postponement of the period of validity are not possible.
- In the event of an accident or illness with health implications.
- The request for refund must be submitted to the ski lift company where the pass was purchased.

In order to obtain a refund, the user must provide a medical certificate (in the case of an accident or illness, stating the duration of the health problem); until this medical certificate is provided, the user is not entitled to a refund. The amount of the refund is determined by the date on which the Axamer Lizum ski pass is deposited with the competent cableway company.

The amount of the refund during the validity period of the Axamer Lizum annual pass is calculated as follows
Deposit: Refund:
- Until 30.11................ 80% of the price of the annual pass.
- Until 31.12................ 60% of annual fare
- Until 28.02............... 30% of the annual card price
- Until 30.04................ 20% of the Annual Fare
- Until 30.06................ 10% of the annual ski pass price

If the Axamer Lizum ski pass has been purchased in connection with the purchase of a family ticket, the amount of the refund to be made to the user concerned will be calculated on the basis of the price that would have been applicable to that user when the total price of the family ticket was calculated.

Misuse
Any misuse of an Axamer Lizum ski pass or combined cards (FTT, TSC, AGM, Ski+City Card) by the user will result in the immediate withdrawal of the card. Misuse is defined in particular as passing on the card to a third party, obtaining the card by giving false information about age, employment status, etc., or by presenting false confirmations. In the event of misuse, the user is also obliged to purchase a valid ski pass and pay a penalty of € 250, and Axamer Lizum reserves the right to report the matter to the police.

Defective data carrier
If a data carrier (key card) is not accepted by the reader, although the lift pass is valid according to the imprint, any partner of Axamer Lizum can issue a "new lift pass". If necessary, the user or customer is obliged to deposit the defective keycard.

Conditions of transport

Closing of lifts and slopes:
After the last control run of the piste service, no further control runs will take place and the slopes are closed to all users.
The use of the entire ski area after the closing of the slopes is dangerous and strictly forbidden. During this time, the slopes are regularly prepared (sometimes with winches that are difficult or impossible for skiers to see).

Ski Touring / Tobogganing / Walking:
Ski touring is permitted in the organised ski area only on the designated ski touring routes during operating hours (08:30 - 16:30).
Walking and sledging are prohibited on the slopes.

Liability:
In accordance with its general terms and conditions, the Axamer Lizum ski resort is only liable for damage in connection with access to the Axamer Lizum ski resort caused by gross negligence or intent. Liability for slight negligence is excluded, except for personal injury.
The Axamer Lizum is not liable for damages caused to the user by the behaviour of third parties.
Furthermore, Axamer Lizum is not liable for damages outside of the secured pistes or on closed pistes, outside of opening hours, as well as on hiking trails and steep slopes and other facilities that do not belong to the Axamer Lizum ski area.

Jurisdiction and applicable law
The agreed place of jurisdiction for disputes arising from this contractual relationship shall be the competent court in Innsbruck, unless mandatory statutory provisions to the contrary apply. Disputes arising from this contractual relationship shall be governed by Austrian law to the exclusion of Austrian international private law. The UN Convention on Contracts for the International Sale of Goods shall not apply. The language of the contract is German.

Order Process / Conclusion of Contract:
The User's order constitutes an offer to enter into a purchase agreement with us. In the online shop, the user makes a binding offer to purchase the tickets in the shopping basket by clicking on the "Buy now with costs" button. By clicking on the button, the user accepts these General Terms and Conditions (for online purchases) and the General Terms and Conditions of Freizeitticket Tirol.

The purchase is only possible if the user fills in all mandatory fields correctly and (for annual tickets and the FTT) uploads a portrait photo.

If the user places an order in the Axamer Lizum web shop, the user will receive an e-mail from Axamer Lizum confirming receipt of the user's order (order confirmation in the form of a voucher with a QR code). This order confirmation does not constitute an acceptance of the user's offer, but merely informs the user that Axamer Lizum has received the user's order. A purchase contract is only concluded when Axamer Lizum sends the user the ordered number of tickets and confirms the delivery in a second e-mail (delivery confirmation).

Period of validity:
The lift ticket voucher purchased is valid for 1 year from the date of issue/purchase. If you are unable to use the lift ticket voucher within one year, you have the right to request a refund. The purchase price of the unredeemed lift ticket voucher will be refunded on request up to 3 years from the date of issue/purchase.

Subject matter of the contract:
The subject matter of the contract is the electronic sale of access authorisations for the lift and leisure facilities of the Axamer Lizum and the Freizeitticket Tirol to be stored on data carriers. If a Freizeitticket Tirol is purchased in the online shop, this ticket entitles the holder to use various partner businesses. The number of partner companies, their usability and further offers can be found in the General Terms and Conditions of the Freizeitticket Tirol.

The individual services to which the Freizeitticket Tirol entitles you are provided by legally independent companies (see General Terms and Conditions of the Freizeitticket Tirol). Axamer Lizum, which sells this ticket online, only acts as an agent for the other partner companies (see General Terms and Conditions of the Freizeitticket Tirol). For the provision of the individual services and for the fulfilment of any claims, such as compensation for damages in the event of incidents, only the respective partner company is responsible.

Right of withdrawal:
Right of cancellation and cancellation period
(§ 11 Distance and Foreign Sales Act - FAGG)
The user has the right to withdraw from a distance or off-premises contract within 14 days without giving reasons. In the case of sales contracts and other contracts for the purchase of goods, the withdrawal period begins

- on the day on which the customer or a third party designated by the user who is not acting as a carrier takes possession of the goods;

- if the User has ordered several goods in a single order and these are delivered separately, on the day on which the User or a third party not acting as a carrier designated by the User takes possession of the last goods delivered;

- in the case of goods delivered in several instalments, on the day on which the user or a third party not acting as a carrier and designated by the user takes possession of the last instalment;

- in the case of contracts for the regular delivery of goods over a fixed period, on the day on which the user or a third party not acting as a carrier and designated by the user takes possession of the first goods delivered.

Right of withdrawal:
In order to exercise the user's right of withdrawal, the user must inform Axamer Lizum GmbH & Co KG, FN 34818d, by means of a clear declaration (e.g. e-mail, letter) of his decision to withdraw from this contract. No special form is required. For this purpose, the user may use the sample form in the appendix (sample form).

Compliance with the withdrawal period:
In order to comply with the withdrawal period, it is sufficient for the user to send the notification of the exercise of the right of withdrawal before the end of the withdrawal period to the following address

Delivery:
Unless otherwise agreed, delivery will be made to the address provided by the user. There are no delivery charges.

Maturity, payment:
Payment must be made by credit card or immediate bank transfer. Once payment has been confirmed, the tickets ordered will be sent to the address indicated by the user, together with the invoice.

Prices:
All prices are inclusive of applicable VAT.

Scope and consumer protection:
With regard to the electronic sale of access cards for the ski lifts and leisure facilities in Axamer Lizum, which are stored on data carriers, the web shop is operated exclusively for customers within the European Union and Switzerland. With regard to the sale of the leisure ticket, the web shop is operated exclusively for customers within Austria.

These General Terms and Conditions shall only apply to the extent that they do not conflict with mandatory provisions of consumer protection law of the respective consumer state.

Any invalid provision shall not be deemed invalid in its entirety, but shall be limited to the content that comes closest to it and is still valid.

Photos and Videos: Webcams (Hoadl Haus and Birgitzköpfl) !
The user acknowledges that photos or short videos may be taken in the Axamer Lizum ski area and in the Axamer Lizum restaurants and published on social media channels. Even if persons are difficult to recognise, the possibility of identification cannot be excluded. The user cannot derive any claims from this.

FACEBOOK & INSTAGRAM GEWINNSPIEL – Teilnahmebedingungen:
Diese Teilnahmebedingungen gelangen zur Anwendung, wenn Personen an Gewinnspielen der Axamer Lizum GmbH & Co KG, Brockenweg 2, 6060 Hall in Tirol, die wir auf unserer Facebook-Seite bzw. auf unserem Instagram-Profil, ohne die Verwendung einer speziellen Gewinnspiel-App – durchführen, teilnehmen. Die aktuelle Fassung der Teilnahmebedingungen ist unter https://www.axamer-lizum.at/de/agbs-axamer-lizum.html abrufbar. Unsere Gewinnspiele stehen in keinerlei Zusammenhang mit Facebook/Instagram, sind also weder gesponsert, unterstützt oder von Facebook/Instagram organisiert sondern ausschließlich auf Initiative der Axamer Lizum GmbH & CO KG durchgeführt.
Der Teilnehmer akzeptiert mit der Teilnahme am Gewinnspiel diese Teilnahmebedingungen und bestätigt die richtige, wahrheitsgemäße und vollständige Angabe der abgefragten Daten.
Der Teilnehmer kann gegenüber Instagram oder Facebook keine Ansprüche geltend machen, die im Zusammenhang mit der Teilnahme am Gewinnspiel entstehen.

Wer kann mitmachen?
Teilnahmeberechtigt an Gewinnspielen sind alle Personen ab dem 18. Lebensjahr mit ständigem Wohnsitz in Österreich. Eine Person darf nur einmal pro Gewinnspiel teilnehmen. Eine Gewinnspielteilnahme ist nur im eigenen Namen möglich. Aktive und ehemalige Mitarbeiter der Axamer Lizum GmbH & Co KG und deren Tochtergesellschaften sowie deren Angehörige sind von der Teilnahme an Gewinnspielen ausgeschlossen. Die Axamer Lizum GmbH & Co KG behält sich das Recht vor Personen, die sich unerlaubter Hilfsmittel bedienen oder sich anderweitig durch Manipulation – wie automatisierte Eintragungen, falsche Facebook bzw. Instagram Accounts - Vorteile verschaffen, mit sofortiger Wirkung von der Teilnahme am Gewinnspiel auszuschließen. Gegebenenfalls können in diesen Fällen auch nachträglich Gewinne aberkannt und zurückgefordert werden. Die Axamer Lizum GmbH & Co KG behält sich weiters das Recht vor, von Teilnehmern einen Nachweis für die Erfüllung der Teilnahmevoraussetzungen einzufordern. Wird dieser Nachweis bei Aufforderung nicht erbracht, kann der Teilnehmer vom Gewinnspiel ausgeschlossen werden.

Wenn ein Freizeitticket Tirol verlost wird, muss der/die Gewinner/in die Bezugsberechtigung zum Erwerb eines Freizeittickets erfüllen: Alle Personen mit Hauptwohnsitz in Tirol sind zum Bezug des FTT berechtigt. Der Nachweis hierfür erfolgt durch Vorlage einer Meldebestätigung (nicht älter als 3 Monate). Ebenfalls berechtigt sind alle Personen mit einem Beschäftigungsverhältnis in Tirol (Vorlage der Sozialversicherungsbestätigung) sowie Studierende der Universität Innsbruck oder einer in Tirol ansässigen Hochschule oder Fachhochschule, die am Tag des Gültigkeitsbeginnes des FTT das 27. Lebensjahr noch nicht vollendet haben (Vorlage eines aktuellen Studiennachweises für das laufende Studienjahr oder Semester).

Was kann ich gewinnen?
Der Preis wird im jeweiligen Gewinnspiel-Posting/Feed-Beitrag oder Story bekannt gegeben. Die Gewinne können nicht getauscht oder in bar abgelöst werden.

Anfang und Ende des Gewinnspiels
Beginn des Gewinnspiels ist jeweils der Veröffentlichungszeitpunkt auf unserer Facebook- oder Instagram Seite, das Ende und der Zeitpunkt der Auslosung wird bei jedem Gewinnspiel separat angegeben. Instagram Reel Gewinnspiele haben eine Mindestteilnehmeranzahl von 10 Personen. Sollten bis zum Ende des Gewinnspiels weniger als 10 Reels hochgeladen worden sein, wird das Gewinnspiel verlängert.

Wie werden die Gewinner ermittelt?
Soweit nichts anderes angegeben wird, erfolgt die Ermittlung der Gewinner durch Zufall. Ausnahmen werden im Gewinnspiel-Posting angegeben (z. B.: Das Bild/Video/Reel mit den meisten Likes/mit der höchsten Reichweite etc. gewinnt, Auswahl des Gewinners durch eine Jury, etc.). Jede/r Teilnehmer/in bekommt nur einen Gewinn. Das Teilen von Beiträgen ist KEINE zwingende Teilnahmebedingung. Bei Co-Autor bzw. Collab-Parnter Beiträgen/Reels erfolgt die Veröffentlichung in unserem Instagram Feed erst und nur nach Freigabe durch unsere Jury. Instagram Reel Gewinnspiele haben eine Mindestteilnehmeranzahl von 10 Personen. Sollten bis zum Ende des Gewinnspiels weniger als 10 Reels hochgeladen worden sein, wird das Gewinnspiel verlängert.

Wie werden die Gewinner benachrichtigt?
Der/die Gewinner/in wird nach Beendigung des Gewinnspiels ermittelt und per Posting auf unserer Facebook/Instagram-Seite schriftlich darüber benachrichtigt. Der/die Gewinner/in hat den Gewinn innerhalb von 5 Tagen annehmen, indem er der Axamer Lizum GmbH & Co KG eine private Nachricht auf Facebook/Instagram mit seiner E-Mail-Adresse und seinem vollständigen Namen retourniert. Wird der Gewinn nicht innerhalb dieser 5-Tage-Frist angenommen, so verfällt der Gewinnanspruch. Der/die zuerst gezogene Gewinner/in hat nach Ablauf der Verfallsfrist keinen Anspruch mehr auf seinen/ihren Gewinn.
Meldet sich der Gewinner nicht innerhalb von 5 Tagen nach Zugang der Gewinnmitteilung, so verfällt der Anspruch auf den Gewinn und es wird ein neuer Gewinner ermittelt. Für die Richtigkeit der angegebenen E- Mail-/Post-Adresse ist der Teilnehmer verantwortlich. Sollten die angegebenen Kontaktmöglichkeiten fehlerhaft sein ist die Axamer Lizum GmbH & Co KG nicht verpflichtet richtige Adressen zu erheben.

Was passiert mit den Daten?
Mit der Teilnahme erklärt sich der Teilnehmer damit einverstanden, dass die von ihm im Rahmen der Teilnahme am Gewinnspiel übermittelten personenbezogenen Daten (Vorname, Nachname, Post-Adresse, E-Mail und Telefonnummer) ausschließlich zur Bearbeitung und Abwicklung des Gewinnspiels verwendet werden sowie die Axamer Lizum GmbH & Co KG über seine Teilnahme am Gewinnspiel und den Gewinn mit Namen und Bild in Online- wie Offlinemedien (zB auf Facebookseite, Instagramseite, Webseite www.axamer-lizum.at oder im Printbereich) berichten darf oder berichten lässt. Im Falle eines Gewinns kann das Bild, sowie der Name des Gewinners in einem eigenen Posting von uns auf unserer Facebook/Instagram Seite veröffentlicht werden. Der Teilnehmer hat ein Recht auf unentgeltliche Auskunft über seine gespeicherten personenbezogenen Daten sowie deren Korrektur und kann seine Zustimmungen jederzeit schriftlich unter Axamer LizumBrockenweg 2, 6060 Hall in Tirol, E-Mail: office@axamer-lizum.at widerrufen und von der Teilnahme am Gewinnspiel zurücktreten.

Sonstiges:
Sofern der Teilnehmer bei Lieferung des Gewinns feststellt, dass der Gewinn fehlerhaft oder beschädigt ist, hat dieser der Axamer Lizum GmbH & Co KG binnen sieben Tagen nach Lieferung zu benachrichtigen. Andernfalls wird der Gewinn als im Lieferzustand akzeptiert angesehen. Die gesetzlichen Rechte der Gewinner werden hierdurch nicht geschmälert. Sachgewinne können nicht in bar abgelöst bzw. an Dritte übertragen werden. Es besteht kein Rechtsanspruch auf einen Gewinn. Der Rechtsweg ist ausgeschlossen.

Die Axamer Lizum GmbH & Co KG behält sich das Recht vor, diese Teilnahmebedingungen nachträglich zu ergänzen sowie Änderungen hinsichtlich der Gewinne und Fristen für die Teilnahme am Gewinnspiel vorzunehmen. Darüber hinaus behält sich die Axamer Lizum GmbH & Co KG das Recht vor, das Gewinnspiel bzw. die Verlosung jederzeit aus wichtigem Grund ohne Vorankündigung zu beenden oder zu unterbrechen. Dies gilt insbesondere für solche Gründe, die einen planmäßigen Ablauf des Gewinnspiels bzw. der Verlosung stören oder verhindern würden. Soweit einzelne Bestimmungen dieser Teilnahmebedingungen rechtsunwirksam sind oder werden, berührt dies die übrigen Bestimmungen nicht. An Ihre Stelle treten angemessene Regelungen, welche dem wirtschaftlichen Zweck der unwirksamen Bestimmungen am nächsten kommen.

Für diese Teilnahmebedingungen gilt ausschließlich österreichisches Recht ohne jene Verweisungsnormen, welche zur Anwendung ausländischen Rechtes führen würden.

Zusätzliche Bedingungen bei Wettbewerben mit Fotos und Kommentaren

Foto-Upload oder Kommentare
Falls du ein Foto uploaden oder einen Beitrag kommentieren sollst, um am Gewinnspiel teilzunehmen, dürfen keine Rechte Dritter insbesondere das Urheberrecht sowie das Recht am Eigenen Bild verletzt werden. Weiteres sind (wie bei allen Beiträgen) alle rechtswidrigen Kommentierungen bzw. Inhalte untersagt, insbesondere rassistische und pornografisch Inhalte sowie Inhalte, welche die Menschenrechte verletzen.

Nutzungsrechte
Mit dem Posten eines Bildes, erklärst du dich ausdrücklich damit einverstanden, dass wir das Bild auf unserer Facebook oder Instagram Seite oder in der Story mit deinem Namen veröffentlichen können. Dein Bild wird von uns nur im Zusammenhang mit dem jeweiligen Gewinnspiel verwendet. Du bist dir jedoch bewusst und ausdrücklich damit einverstanden, dass die eingestellten Bilder und Texte auch über die Axamer Lizum GmbH & Co KG sowie Dritte in sozialen Medien (insbesondere Facebook und Instagram) diskutiert und verlinkt werden können. Die Axamer Lizum GmbH & Co KG behält sich vor, eingereichte Beiträge entweder gar nicht oder abgeändert bzw. gekürzt zu veröffentlichen, sofern hierdurch deren Sinn nicht entstellt wird.
